Changes to the ATSU Copyright Policy & What It Means for You!

After attending a recent webinar on Copyright, which CGHS Instructional Designer Sue McDaniel found for us, the library is changing its copyright Policy.  Below are the changes affecting our Fair Use interpretation and the posting of articles or book chapters obtained through Inter Librarian Loan in BlackBoard as part of course materials.

Pre March 2015

Fair Use Rule - #3 The amount and substantiality used in relation to the materials as a whole.

  • Book – 1 chapter or 10% (whichever is greater)
  • Article – 1 article or 10% of the Journal (whichever is greater)

Maintaining Copyright Compliance – ATSMLib generally recommends that copyright permission be sought when:

  • Any book chapter or article, which the library does not own or to subscribe, must be reordered every semester or at such time the course is being taught.
  • The amount of a material from a book or journal exceeds that deemed permissible according to the Fair Use law.

Our New Policy – Post March 2015

  • Example:  Material used does not constitute the "heart of the work."

Maintaining Copyright Compliance – ATSMLib generally recommends that copyright permission be sought when:

  • The amount of a material from a book or journal exceeds that deemed permissible according to the Fair Use law.

What does this mean for you when it comes to creating a course or finding supplementary materials?

  • It is much more lenient!  You can now order a single book chapter or article via Inter Library Loan and use it in your Blackboard course for an indefinite amount of time.
  • The amount of content that can be used and still be considered within Fair Use within your courses is also much greater and this relates to books or articles both owned by the library or obtained through Inter Library Loan.

Things to keep in mind!

  • Content obtained through the library resources and used within your courses helps the library justify purchasing subscriptions to new journals or providing access to new e-books.  So – please use library resources whenever possible before ordering an article(s) or book chapter(s) through Inter Library Loan.
  • Our goal is to help maintain copyright compliance and we are happy to discuss previous and current policies with anyone at any time.
